Welcome to ArborTote. These Terms & Policies (“Terms”) govern your use of our products, services, website, and digital platform. By purchasing or using any ArborTote products or services, you agree to these Terms. If you do not agree, please do not use our products or services.

Product Classification

ArborTote products are classified as fertilizers, soil amendments, and plant health support products. They are not pesticides and are not intended to diagnose, mitigate, treat, cure, or prevent plant diseases, insects, or pests. All products are intended for use in accordance with applicable state fertilizer laws and labeling requirements.

Directions for Use Compliance

All ArborTote products must be used in accordance with the instructions provided on the product label and accompanying materials. Use of any product in a manner inconsistent with its labeling may result in plant injury or reduced effectiveness. The user assumes full responsibility for any use that deviates from labeled directions.

Product Performance Disclaimer

The performance of ArborTote products depends on a variety of factors beyond our control, including soil composition, environmental conditions, plant species, and application practices. As a result, no guarantee is made regarding specific outcomes or performance.

Warranty Disclaimer

To the fullest extent permitted by law, ArborTote makes no express or implied warranties, including warranties of merchantability or fitness for a particular purpose. All products are provided “as is” and “as available.”

Limitation of Liability

To the maximum extent permitted by law, ArborTote shall not be liable for any loss or damage arising from the use or misuse of its products. This includes, but is not limited to, plant or turf damage, crop loss, reduced growth, or any indirect, incidental, or consequential damages. The buyer and user assume all risks associated with handling and application.

Handling, Storage, and Application Responsibility

Users are responsible for proper storage, handling, and application of all products. This includes maintaining appropriate storage conditions, preventing contamination, and following proper mixing and dilution practices. Failure to do so may result in reduced product performance or plant damage.

Digital Platform and AI Disclaimer

ArborTote may provide recommendations through its digital platform, including plant identification, health assessments, and treatment guidance. These recommendations are based on available data and user inputs and are intended for informational purposes only. They are not guaranteed to be accurate or complete and do not replace professional judgment or certified arborist advice. All decisions made based on these recommendations are at the user’s discretion and risk.

Orders, Pricing, and Payment

All orders are subject to acceptance. ArborTote reserves the right to refuse or cancel any order at its discretion. Prices, promotions, and product availability may change without notice. Customers agree to provide accurate and complete billing and payment information.

Shipping and Delivery

Orders are processed within standard business timelines. Due to the nature of liquid fertilizer products, certain shipments may require specialized handling and may be subject to carrier restrictions. Delivery timelines are estimates and may be impacted by factors outside of ArborTote’s control.

Returns and Refunds

Returns are accepted within 30 days of delivery, provided the product is unused, in its original packaging, and accompanied by proof of purchase.

Privacy

We collect and use personal information to provide and improve our services, process transactions, and support platform functionality. Certain data may be processed by third-party providers such as Shopify in order to operate our services effectively.

Governing Law

These Terms are governed by the laws of the State of Wyoming.

ArborTote reserves the right to update or modify these Terms at any time. Continued use of our products or services constitutes acceptance of any changes.
